Terms of Service

Effective June 5, 2026

These Terms of Service ("Terms") are an agreement between you and Cal Sierra Investments, Inc. ("we," "us," or "our") and govern your use of the my time application and related services (the "Service"). By creating an account, signing in, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

my time is a workforce time-tracking tool for businesses. It lets a business and its staff record clock-in and clock-out times and review hours, schedules, and pay information. The Service is provided to businesses for use by their employees and is intended for business use.

2. Accounts and eligibility

A business may create an account to manage its workforce. Employees access the Service by invitation from their employer and use it to record their own working time. You must be at least 16 years old and authorized by the relevant business to use the Service. You are responsible for keeping your sign-in credentials confidential and for all activity that occurs under your account. Notify us promptly of any unauthorized use.

3. Employer and employee responsibilities

The business (the "Employer") that creates an account is responsible for its workforce data, for inviting and managing its employees, and for ensuring its use of the Service complies with applicable employment, wage-and-hour, and privacy laws. Employees are responsible for accurately recording their own time. We provide the tools; the Employer remains the controller of, and is responsible for, the time and pay records it maintains through the Service.

4. Acceptable use

You agree not to misuse the Service, including by: accessing it without authorization; falsifying time or pay records; interfering with or disrupting the Service; reverse-engineering or copying it; or using it to violate any law or the rights of others. We may suspend or terminate access for conduct that violates these Terms.

5. Fees and paid plans

The Service may be offered free of charge or under a paid plan. Where a paid plan applies, the fees, billing period, and terms are presented to you at the point of purchase, and any purchase made through a mobile app store is processed and billed by that app store under its terms. You authorize the charging of applicable fees through the payment method or platform you select at purchase. Except as required by law or the applicable app store's policies, fees are non-refundable.

6. Intellectual property

The Service, including its software, design, and content, is owned by Cal Sierra Investments, Inc. and its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended business purpose, subject to these Terms. You retain ownership of the data you submit; you grant us a license to host and process that data solely to provide the Service.

7. Privacy

Our handling of personal information is described in our Privacy Policy, available at https://summitenergyholdings.com. By using the Service you consent to that handling.

8. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that records will be free of inaccuracies. You are responsible for verifying time and pay records used for compliance or payroll purposes.

9. Limitation of liability

To the fullest extent permitted by law, Cal Sierra Investments, Inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or wages, arising out of or relating to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve months before the event giving rise to the claim, or USD $100 if you paid nothing.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or other users. On termination, your right to use the Service ends; sections that by their nature should survive (including ownership, disclaimers, and limitation of liability) will survive.

11. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will provide notice through the Service or by other reasonable means. Your continued use after the changes take effect constitutes acceptance of the updated Terms.

12. Governing law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. Any dispute will be resolved in the courts located there, and you consent to their jurisdiction.
